1. General Information
This Privacy Policy for Online Applications informs you about the nature, scope, and purpose of the processing of personal data within our “Applicant Management System” and the associated websites, functions, and content. By registering with BAM, you are providing the agency with your personal data in connection with a specific application for the purpose of job searching. Your data is stored and processed on the systems of our software partner, milch & zucker GmbH.

3. Data Protection and Confidentiality
Data protection is a matter of great importance to us. BAM and our software partner milch & zucker GmbH have implemented the necessary organizational and technical measures to ensure the confidentiality of your application. All employees of the Human Resources Department as well as our software partner are bound by confidentiality regarding personal data as part of their employment relationship. Thanks to automatically activated 128-bit encryption, the secure transmission of your data is ensured. During data processing, general data security standards in accordance with the current state of the art are observed.
4. Use of Your Personal Data
During the application process, in addition to your title, last name, and first name, standard contact information such as your mailing address, email address, and phone numbers will be stored in the applicant database. Additionally, application documents such as a cover letter, resume, professional qualifications, educational credentials, and work references will be recorded.
This data is stored, evaluated, processed, or forwarded internally exclusively in connection with your application. It is accessible only to employees of the Human Resources Department and to those at BAM responsible for the selection process. Under no circumstances will your data be disclosed to companies or individuals outside of BAM or used for other purposes.
The data may be processed for statistical purposes (e.g., reporting). No conclusions regarding individual persons can be drawn from this.
We generally do not require any special categories of personal data within the meaning of Art. 9 GDPR for the application process. We ask that you refrain from providing us with such information from the outset. If, in exceptional cases, such information is relevant to the application process, we will process it together with the other applicant data. This may, for example, concern information regarding a severe disability, which you may voluntarily provide to us and which we must then process to fulfill our specific obligations regarding persons with severe disabilities. In these cases, the processing serves the exercise of rights or the fulfillment of legal obligations arising from labor law, social security law, and social protection law.
The legal basis for data processing in such cases is Article 9(2)(b) of the GDPR, Section 26(3) of the BDSG, and Section 164 of SGB IX. In exceptional cases, it may be necessary to obtain information regarding health or a disability, or information from the Federal Central Register (i.e., regarding criminal records), in order to assess suitability for the intended position. The legal basis for this is § 26 BDSG.
After the application process is completed, your personal data will be stored until the expiration of the period specified in Section 7 for documentation purposes and for the purpose of defending legal claims.
5. Legal basis for the processing of personal data
The collection and processing of personal data is carried out exclusively on the basis of Art. 6(b) and 6(f) of the GDPR.
6. Storage and deletion of data
If you take up a position at BAM, your personal data, or at most an excerpt thereof, will be added to your personnel file.
If you have applied but received a rejection notice, your information will be stored for approximately 6 months after the conclusion of the application process and then deleted (profile and application). You will not be notified of the deletion of the data.
If you have applied but we are unable to offer you a suitable position at this time, we reserve the right to add your application to a talent pool. In this case, you will receive a message for your information. If you do not agree with this or are no longer interested, you may delete your data (profile and application) yourself at any time. If your application is added to a talent pool, the data will be stored for 12 months and then deleted.
